Terms and Conditions
1. Accuracy of Information
I take full responsibility for any consequences that may arise out of false/incomplete information provided to EBO SACCO and the SACCO reserves the right to verify any information provided at any time for as long as I hold the account.
2. Binding Terms
I agree to be bound by any additional terms and conditions governing any products and/or services offered by the SACCO as may apply from time to time. I undertake to indemnify the SACCO against any loss caused for breach of the terms and conditions.
3. Communication
Any communication to the Customers on the SACCO’s products and/or services shall be deemed to have been done effectively if communicated to the Customer by posting, phone call, using any media platforms including social media, display in the SACCO’s premises, verbal explanation by SACCO’S staff, SACCO’s website, SMS alerts, correspondence to the destined customer, one account holder for joint account holders or through all other appropriate means.
4. Charges and Fees
EBO SACCO reserves the right to impose charges or fees or levies or taxes or debit my account at any one time for breach of any terms and conditions governing any products and/or services offered by the SACCO from time to time.
5. Amendments
Any request for a change or amendment or variation of information supplied to the SACCO shall be done in writing or in any way that the SACCO may deem appropriate from time to time. The SACCO reserves the right to accept or decline the change or amendment or variation.
6. Provision of Information & Confidentiality
I agree to supply any information to the SACCO upon request by including all statements, information, material, and explanations as may be reasonably required by the SACCO from time to time. Any information supplied to EBO SACCO shall be held and used for a period stipulated, required and allowed by the laws of Uganda.
Any information supplied by the Customer shall be held and used for commercial, financial, regulatory or any other purpose and in a manner permitted by the laws of Uganda. All information shall be held in strict confidentiality unless otherwise as permitted by law or compulsion by court to be issued out.
7. Withdrawals & Force Majeure
EBO SACCO shall have the option to ask to be informed in advance of the intended withdrawal by any Customer of large sums of money so as to be able to make appropriate arrangements to have the funds available.
EBO SACCO will not be held liable for any loss/ damage to its customers or delay or failure to perform any of its obligations occasioned due to unforeseen events caused by events beyond its reasonable control (‘Force Majeure event”) including but not limited to technological interruptions.
8. Charges, Variations, and Governing Law
I agree and accept that I am liable for all the charges, fees, taxes, commissions and others incurred through use and access of the SACCO’s products and services.
These terms and conditions may be changed, varied, amended, complemented from time to time and shall not be exhaustive of all terms and conditions governing the SACCO’s products and/or services.
The terms and conditions of EBO SACCO products and/or services shall be regulated and governed in accordance with the Laws of Uganda and the parties submit to the exclusive jurisdiction of the Ugandan courts.
9. Account Closure & Joint Accounts
Upon the SACCO receiving notice of the demise of an individual Account Holder, the SACCO will not be obliged to allow any operation or withdrawal from the account by any person except on production of a death certificate and a court order from a court of competent jurisdiction or any other relevant document recognised by law for succession purposes.
In cases of a joint account and one of the account holders dies and where the account mandate allows, then the money in the account and any other benefit, interest or obligation relating to that account will revert to the surviving joint holder(s).
No account holder may alter or delete any entries in the statement of account. Any discrepancy found, should at once be brought to notice of the SACCO, if the statement of account is lost or spoilt, a duplicate statement of account may be provided by the SACCO, subject to such charge as is applicable under its schedule of charges.
The SACCO reserves the right in its sole discretion to close any account with prior reasonable notice, which in its opinion is not satisfactorily operated at the SACCO’s discretion, or forthwith if the account is involved in illegal activity or pursuant to a court order.
Account holders wishing to close their account must, surrender any Verve cards and any other documents or instruments issued by the SACCO on the account. The account holder will also be liable for account closing charges as in force, before they can be paid the last remaining credit balance, if any.
10. Cards, Access Codes & Security
Where the account holder is issued with a Verve card, mobile banking access codes or any other tool or code for the purpose of gaining access to one’s account, the account holder undertakes not to transfer/share/reveal the same to any other person and undertakes to exercise due care and attention to ensure their safety and the secrecy of the PIN thereof. Where the account is a joint account, the joint holders undertake to ensure that the Verve card, mobile banking access codes or any other tool or code for the purpose of gaining access to one’s account is only used by authorised person(s) who operate that account.
If a card is lost or stolen or if the PIN is disclosed to an unauthorised person, the account holder(s) must immediately notify the SACCO in writing and the cardholder will be liable for any transaction made prior to the receipt by the SACCO of such notification.
The account holder may at any time cancel his or her Verve card, mobile phone access codes or any other tool or code for the purpose of gaining access to one’s account and notify and return the same to the SACCO provided the account holder must not attempt to use the mobile phone access codes or any other tool or code for the purpose of gaining access to their account, after such notification of cancellation.
The SACCO reserves the right to withdraw the right to use the card, refuse to renew, replace or reissue without assigning a reason and without incurring any liability to a cardholder.
The SACCO may request additional information from the account holder when required.
11. Complaints
The account holder has a right at any time to lodge a complaint by communicating with the SACCO through the various communication channels that shall be provided by SACCO from time to time.
I/WE have read and/or been explained to the terms and conditions governing the SACCO’s facilities, products and or services. I/WE have fully appreciated the same and agree to be bound by the terms and conditions.
